License Agreement

1. What This Agreement Covers

This License Agreement ("Agreement") governs your use of any photograph purchased from Photographium.com ("Photographium," "we," "us"). By completing a purchase, you ("Licensee") agree to the terms below.

2. Grant of License

Upon payment, Photographium grants you a license to use the purchased photograph as described in this Agreement. For photographs labeled Rights Managed, that license is strictly limited to the specific license package you selected at checkout (e.g. Editorial, Print & Publication, Interior & Architectural Display, Commercial Use, Broadcast & Film, or Exclusive Rights) — the exact permissions and restrictions for each package are described on our Licensing page, which forms part of this Agreement. For photographs labeled Public Domain or Photographium-Retouched, Section 3 below applies instead.

3. Public Domain and Photographium-Retouched Photographs

Photographs on the Site labeled "Public Domain" and "Photographium-Retouched" are not sold under the Rights Managed package system described above, and are treated differently under this Agreement:

3.1 Public Domain photographs. These photographs are not subject to copyright, and Photographium does not claim, and cannot grant, any exclusive rights in the underlying image itself. Purchasing a Public Domain photograph provides you with a high-resolution digital file of that image, delivered through our service, for your convenience — it does not constitute the grant of a copyright license, because none is required. You may use a Public Domain photograph without restriction arising from copyright law. However, you agree not to redistribute, resell, sublicense, or otherwise make available the specific file delivered to you by Photographium as a standalone product, dataset, or stock photo offering in competition with Photographium (for example, collecting files purchased from Photographium and reselling or republishing them, in bulk or individually, as your own archive or stock collection).

3.2 Photographium-Retouched photographs. These photographs are based on public domain source material that has been manually restored, corrected, and retouched by Photographium. While the underlying historical image remains in the public domain, the specific retouched version delivered to you may constitute a separate, original work in which Photographium holds rights independent of the underlying image. Your purchase of a Photographium-Retouched photograph grants you a non-exclusive, non-transferable license to use that specific retouched version for your own purposes. It does not grant you any rights in Photographium's restoration or retouching work itself, separate from that use — you may not extract, isolate, resell, sublicense, or redistribute the retouched file as a standalone product, or represent the retouching work as your own.

3.3 Both Public Domain and Photographium-Retouched photographs remain subject to Section 5 (No Model or Property Releases) and Section 6 (No Warranty) below, and to Section 9 (Delivery) governing how and when files are shared with you.

4. Restrictions (Rights Managed Photographs)

For photographs purchased under a Rights Managed license package, you may not use the photograph in any way not expressly permitted under your selected license package. Without limitation, and unless your package expressly allows it, you may not: (a) use the photograph for advertising or promotional purposes; (b) reproduce it on merchandise intended for resale; (c) sublicense, resell, or redistribute the photograph itself, whether alone or bundled with other material; or (d) claim exclusive ownership of the photograph.

5. No Model or Property Releases

Given the historic and archival nature of our collection, Photographium does not represent or warrant that any model releases, property releases, or similar consents exist for any individuals, brands, trademarks, or private property that may appear in a photograph, unless expressly stated otherwise for a specific image. This applies to all photographs on the Site, regardless of license type. You are responsible for independently assessing whether your intended use requires such releases and for obtaining them if necessary.

6. No Warranty

Photographs are provided "as is." Except as expressly stated in this Agreement, Photographium makes no warranties, express or implied, regarding any photograph, including as to its fitness for any particular purpose.

7. Ownership and Copyright

Except as described in Section 3 for Public Domain photographs, purchasing a license does not transfer copyright or any ownership interest in a photograph to you. Photographium (or the applicable rights holder) retains all rights not expressly granted under this Agreement.

8. Limitation of Liability

To the fullest extent permitted by law, Photographium's total liability arising from or related to any single purchase shall not exceed the amount you paid for that specific photograph.

9. Delivery

Full-resolution files are made available for download directly through your account on Photographium.com, typically within 24 hours of purchase, and can be accessed via the "My Purchases" section of your account. The file remains available for 7 days from the date of purchase. It is your responsibility to download the file within this window; Photographium is not obligated to re-provide access to a file after this period has passed, though we will make reasonable efforts to assist if you contact us promptly.

10. Refunds

Because purchases involve the delivery of a digital file, purchases are generally non-refundable once the file has been delivered, except where required by applicable law.

11. Termination

Any use of a photograph outside the scope permitted under this Agreement immediately and automatically terminates the license granted to you, without prejudice to any other remedies available to Photographium.

12. Governing Law

This Agreement is governed by the laws of Turkiye, without regard to its conflict of law principles.
