1. Acceptance of These Terms

By accessing or using Photographium.com (the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Site.

2. Description of Service

Photographium is a boutique archive of historic photographs available for browsing, and, where indicated, for licensed purchase. Registered users may access additional features, including a personal account area for viewing past purchases ("My Purchases") and saved favorites ("My Favorites").

3. Accounts

You may browse the Site without an account. Creating an account requires a valid email address and agreement to these Terms. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

4. Privacy

Our Privacy Policy explains what personal information we collect, how we use it, and your rights regarding it. By using the Site, you also agree to that Privacy Policy.

5. Acceptable Use

You agree not to: (a) use any automated system (including bots or scrapers) to access the Site in a manner that sends more requests than a human could reasonably produce; (b) attempt to gain unauthorized access to any part of the Site or its underlying systems; (c) interfere with or disrupt the Site's operation; or (d) use the Site for any unlawful purpose.

6. Purchases and Licensing

Purchasing a photograph from Photographium grants you a license to use that photograph strictly according to the specific license package selected at checkout. The terms governing that use are set out separately in our License Agreement, which you must agree to at the time of purchase. Browsing the Site does not itself grant any rights to use any photograph.

7. Third-Party Services

Payments are processed by a third-party payment provider (currently LemonSqueezy). Full-resolution files purchased through the Site are delivered directly through your account on the Site, as described on our Secure Delivery page. Your use of the payment provider is also subject to its own terms and privacy policy, which we encourage you to review.

8. Intellectual Property of the Site

The design, layout, branding, and code of the Site itself (as distinct from the individual photographs available for license) are the property of Photographium and may not be copied, reproduced, or reused without permission.

9. Disclaimer of Warranties

The Site and its content are provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement, except as expressly stated in our License Agreement.

10. Limitation of Liability

To the fullest extent permitted by law, Photographium shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of Turkiye, without regard to its conflict of law principles.
